1. Introduction and Acceptance
Welcome to NoJoke, a marketplace platform owned and operated by One Eighty Event Sdn Bhd (Registration No.: 201901006113 (1315440-P)), a company incorporated under the laws of Malaysia ('NoJoke', 'we', 'us', or 'our').
These Terms and Conditions ('T&C') constitute a legally binding agreement between you ('User', 'you', or 'your') and NoJoke governing your access to and use of the NoJoke website (www.nojoke.com.my), mobile applications, and all related services (collectively, the 'Platform').
We reserve the right to modify these T&C at any time. Continued use of the Platform after any changes constitutes your acceptance of the revised T&C. The version date at the top indicates when the document was last updated.
2. Platform Overview
NoJoke.com.my is a multi-category online marketplace providing:
- New, second-hand, and borrowing/lending marketplace for books and reading materials
- A platform for third-party merchants in education, lifestyle, cultural, and creative industries
- A membership and loyalty points system for purchases and redemption
- Offline events related to the books and education industry
- In-person membership recruitment and points-earning activities
NoJoke acts as an intermediary platform connecting Buyers and Sellers. NoJoke is not the seller of record for third-party merchant listings unless explicitly stated.
3. Eligibility
To use the Platform, you must:
- Be at least eighteen (18) years of age, or the age of majority in your jurisdiction
- Have the legal capacity to enter into binding contracts under Malaysian law
- Not be barred from receiving services under applicable law
- Provide accurate, current, and complete registration information
By registering, you represent and warrant that you meet all eligibility requirements. NoJoke reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion.
4. Account Registration
4.1 Account Creation
You must create an account to access certain features. You agree to:
- Provide truthful, accurate, and complete information during registration
- Maintain and update your account information to keep it current
- Maintain the confidentiality of your login credentials
- Notify us immediately at support@nojoke.com.my of any unauthorized account access
- Accept responsibility for all activities conducted through your account
4.2 Account Types
NoJoke offers the following account types:
- Guest User — Limited browsing access without registration
- Registered Buyer — Full purchase capabilities and points accrual
- Registered Seller / Merchant — Ability to list and sell items on the Platform
- NoJoke Member — Access to enhanced points benefits, offline event participation, and member-exclusive offers
4.3 Account Suspension and Termination
NoJoke reserves the right to suspend, restrict, or permanently terminate any account that violates these T&C, engages in fraudulent activity, or poses risk to the Platform, other users, or NoJoke.
5. Marketplace Listings — Books and Reading Materials
5.1 New Books
New books listed on the Platform must be genuine, unused, and in their original condition with all original packaging intact. Sellers warrant that all new book listings are authentic and sourced from legitimate suppliers.
5.2 Second-Hand Books
Second-hand book listings must accurately describe the condition of the item using NoJoke's standardised condition ratings:
- Like New — Appears unread, no visible wear
- Very Good — Minimal signs of use, may have minor markings
- Good — Some wear, possible highlighting or annotations, fully readable
- Acceptable — Heavy wear, significant markings, but complete and legible
Sellers must disclose all material defects, damage, or missing components in the listing description. Misrepresentation of condition is a material breach of these T&C.
5.3 Book Borrowing / Lending
The borrowing feature allows registered users to lend and borrow physical books through the Platform. Users participating in borrowing arrangements agree to:
- Handle borrowed items with reasonable care
- Return items in the same or better condition within the agreed borrowing period
- Be liable for damage or loss beyond normal wear and tear
- Comply with all borrowing terms set by the lender and by NoJoke
NoJoke provides the matching and transaction infrastructure but is not party to the physical lending arrangement. Disputes regarding borrowed items are primarily between the Borrower and Lender.
6. Third-Party Merchants
NoJoke may permit third-party merchants operating in education, lifestyle, cultural, creative, and related industries to list products and services on the Platform ('Third-Party Merchants').
- Third-Party Merchants must register and be approved by NoJoke before listing
- Each Third-Party Merchant is responsible for the accuracy of their listings
- NoJoke does not endorse or warrant any Third-Party Merchant's products or services
- Transactions with Third-Party Merchants are subject to additional merchant-specific terms disclosed at the point of purchase
- NoJoke may remove any Third-Party Merchant or listing at its sole discretion
In disputes between Users and Third-Party Merchants, NoJoke may, at its discretion, provide mediation assistance but is not liable for the outcome of such disputes.
7. NoJoke Points System
7.1 Earning Points
Registered Members may earn NoJoke Points ('Points') through the following activities:
- Online purchases on the Platform — Points awarded per eligible transaction
- Offline event participation — Points awarded for attending or participating in NoJoke-organised events
- Offline membership activities and recruitment — Points awarded per NoJoke's current schedule
- Promotional campaigns and bonus point events as announced by NoJoke
7.2 Redemption
Points may be redeemed as follows:
- As a discount toward future eligible purchases on the Platform
- For specific rewards, vouchers, or event access as announced by NoJoke
- Subject to minimum redemption thresholds as determined by NoJoke from time to time
7.3 Points Terms and Restrictions
- Points have no cash value and cannot be transferred, sold, or exchanged for cash
- Points are non-transferable between accounts
- Points may expire after twelve (12) months of account inactivity unless otherwise stated
- NoJoke reserves the right to adjust, suspend, or terminate the Points program with thirty (30) days' notice
- Points obtained through fraudulent means will be forfeited and the account may be suspended
- Points balances may be adjusted to correct errors or fraud
8. Pricing, Payment, and Fees
8.1 Pricing
Prices on the Platform are listed in Malaysian Ringgit (MYR) unless otherwise stated. Prices include applicable taxes where indicated. NoJoke reserves the right to change prices at any time without notice prior to order confirmation.
8.2 Payment Methods
NoJoke accepts the following payment methods (subject to availability): Credit and debit cards (Visa, Mastercard), FPX online banking, E-wallets (GrabPay, Touch 'n Go eWallet, Boost, and others), Buy Now Pay Later services, and NoJoke Points. All payment processing is handled by licensed third-party payment gateway providers. NoJoke does not store full payment card data on its servers.
8.3 Platform Fees
NoJoke may charge Sellers a commission or listing fee as set out in the Seller Merchant Agreement. Buyer transaction fees, if any, will be disclosed at checkout before payment is confirmed.
9. Order Processing, Delivery, and Returns
9.1 Order Confirmation
An order is confirmed when NoJoke sends an order confirmation to the Buyer's registered email address. NoJoke reserves the right to cancel any order for reasons including payment failure, stock unavailability, suspected fraud, or pricing errors.
9.2 Delivery
Delivery timelines and shipping fees depend on the Seller, item weight, dimensions, and delivery destination. Estimated delivery times are not guaranteed and may be subject to delays by third-party logistics providers. Risk of loss and title for items pass to the Buyer upon delivery.
9.3 Returns and Refunds
Returns and refund eligibility are governed by NoJoke's Return Policy. Key principles:
- New items may be returned within seven (7) days of receipt if unopened and in original packaging
- Second-hand items may be returned within three (3) days of receipt if the condition was materially misrepresented
- Borrowed items must be returned per the borrowing agreement terms
- Refunds will be processed to the original payment method within ten (10) to fourteen (14) business days of return receipt
- Shipping costs for returns due to Seller error are borne by the Seller; all other return shipping costs are borne by the Buyer
10. Seller Obligations
If you list items for sale on the Platform as a Seller, you agree to:
- Provide accurate, complete, and non-misleading product descriptions and images
- Only list items you legally own or have authority to sell
- Not list counterfeit, pirated, prohibited, or illegal items
- Fulfil confirmed orders promptly and in accordance with stated timelines
- Communicate with Buyers in a professional and timely manner
- Comply with all applicable Malaysian laws, including consumer protection and intellectual property laws
- Remit applicable taxes on your sales as required by Malaysian tax law
NoJoke reserves the right to remove listings, suspend Seller accounts, and withhold payouts pending investigation of suspected policy violations.
11. Prohibited Activities
The following activities are strictly prohibited on the Platform:
- Listing or selling counterfeit, pirated, or copyright-infringing books or materials
- Listing items that are illegal under Malaysian law
- Engaging in fraudulent transactions, fake reviews, or deceptive practices
- Attempting to circumvent NoJoke's payment systems (off-platform transactions)
- Harassing, threatening, or abusing other Users, Sellers, or NoJoke staff
- Creating multiple accounts to abuse promotional offers or Points rewards
- Using automated bots, scrapers, or tools without NoJoke's written consent
- Uploading malicious code, viruses, or harmful content
- Violating any intellectual property rights of NoJoke or third parties
- Any activity that disrupts the integrity or operations of the Platform
Violation of these prohibitions may result in immediate account suspension, Points forfeiture, legal action, and referral to law enforcement authorities.
12. Intellectual Property
All content on the Platform, including but not limited to logos, trademarks, software, text, graphics, images, design, and the NoJoke name, is owned by or licensed to One Eighty Event Sdn Bhd and is protected by Malaysian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial purposes. You must not reproduce, distribute, modify, create derivative works of, or commercially exploit any Platform content without NoJoke's prior written consent.
User-generated content (such as product reviews, images, or listings) remains owned by the User, but by posting such content, you grant NoJoke a worldwide, royalty-free, perpetual licence to use, display, reproduce, and distribute such content on the Platform and in marketing materials.
13. Offline Events
NoJoke organises offline events related to the books and education industry. By registering for or attending NoJoke offline events, you agree to:
- Comply with all event rules and codes of conduct
- Allow NoJoke to photograph or record the event and use such content for promotional purposes
- Acknowledge that Points earned at offline events are subject to these T&C
- Accept that event schedules, venues, and content may change without prior notice
NoJoke's liability for offline events is limited to the direct cost of event participation fees paid by the attendee.
14. Disclaimers and Limitation of Liability
THE PLATFORM IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOJOKE DISCLAIMS ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
NOJOKE DOES NOT WARRANT THAT: (A) THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE; (B) LISTINGS ARE ACCURATE OR COMPLETE; (C) RESULTS FROM USING THE PLATFORM WILL MEET YOUR EXPECTATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY MALAYSIAN LAW, NOJOKE'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE T&C OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM; OR (B) MYR 500.00.
NOJOKE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
15. Indemnification
You agree to indemnify, defend, and hold harmless NoJoke, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your breach of these T&C; (c) your listings, content, or conduct; or (d) your violation of any third party's rights or applicable law.
16. Governing Law and Dispute Resolution
These T&C are governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law principles.
In the event of any dispute, claim, or controversy arising out of or relating to these T&C or the Platform, the parties shall first attempt resolution through good-faith negotiation within thirty (30) days of written notice.
If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Malaysia. Nothing in this clause prevents either party from seeking urgent injunctive relief from a competent court.
17. Miscellaneous
- Entire Agreement — These T&C, together with the Privacy Policy and Terms of Use, constitute the entire agreement between you and NoJoke
- Severability — If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force
- Waiver — NoJoke's failure to enforce any right or provision does not constitute a waiver of that right
- Assignment — You may not assign your rights or obligations under these T&C without NoJoke's prior written consent
- Force Majeure — NoJoke is not liable for failure to perform due to circumstances beyond its reasonable control
